Terms of Service

Agreement to terms

By downloading, installing, or using Cleared (“the App”), you agree to be bound by these Terms of Service (“Terms”). The App is published by NKC Investments LLC (“we,” “us,” or “our”). If you do not agree to these Terms, do not use the App.

This agreement is between you and NKC Investments LLC, and not with Apple Inc. (“Apple”). NKC Investments LLC is solely responsible for the App and its content.

License to use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes on any Apple device that you own or control, subject to the Usage Rules set forth in the Apple Media Services Terms and Conditions.

What the App does

Cleared helps you organize and manage your photo library by identifying and grouping photos by the people in them using on-device face detection. The App can delete photos from your library at your direction and create encrypted backups before deletion. All processing occurs on your device.

Subscriptions and billing

Cleared offers the following subscription options:

Monthly: $10.99 per month, full access, cancel anytime
Annual: $23.88 per year ($1.99/month), includes a 3-day free trial
Lifetime: $39.99 one-time purchase, perpetual access

Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.

You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase (Settings → Apple ID → Subscriptions).

Free trial eligibility is determined by Apple. If you cancel during the free trial period, you will not be charged.

Refunds

All purchases are processed by Apple. To request a refund, visit reportaproblem.apple.com or contact Apple Support. NKC Investments LLC does not process refunds directly.

Your responsibilities

You agree to:

Use the App only for its intended purpose
Not reverse engineer, decompile, or disassemble the App
Not use the App for any unlawful purpose
Take responsibility for any photos you choose to delete — we strongly recommend creating a backup first

Photo deletion and backups

When you delete photos through Cleared, they are moved to your iPhone's Recently Deleted album, where they remain for approximately 30 days before permanent deletion by iOS. While Cleared offers encrypted backup functionality, it is your responsibility to save and secure your backup files. NKC Investments LLC is not responsible for any lost photos or data.

Maintenance and support

NKC Investments LLC is solely responsible for providing maintenance and support for the App. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App. You may contact us at support@clearedapp.app for support inquiries.

Disclaimer of warranties

The App is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or that face detection results will be 100% accurate. Apple has no warranty obligation whatsoever with respect to the App.

Product claims

NKC Investments LLC, not Apple, is responsible for addressing any claims you or any third party may have relating to the App or your possession and use of the App, including but not limited to: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.

Intellectual property

The App, including its design, features, code, and content, is owned by NKC Investments LLC and is protected by copyright and other intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand features.

In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, NKC Investments LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

Limitation of liability

To the maximum extent permitted by applicable law, NKC Investments LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of photos, or loss of profits, arising out of or related to your use of the App.

Third-party beneficiary

You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

Changes to these terms

We may update these Terms from time to time. When we do, we will post the revised Terms here with a new “Last updated” date. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.

Governing law

These Terms are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflict of law principles.
